Definitions

Customer: any professional or private individual capable within the meaning of articles 1123 et seq. of the Civil Code, or legal entity, who visits the website which is the subject of these general terms and conditions.

Content: all the elements making up the information present on the website, in particular text – images – videos.

Customer Information: hereinafter referred to as “Information” which corresponds to all personal data which may be held by arteck-design.com for the management of your account, customer relations management and for analysis and statistical purposes.

User: Internet user connecting to and using the aforementioned site.

Personal information: “Information which enables, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies” (article 4 of law no. 78-17 of 6 January 1978).

The Customer may not in any way re-use, transfer or exploit all or part of the elements or works on the website for their own benefit.

    Use of the arteck-design.com website implies full acceptance of the general terms and conditions of use set out in full below. These conditions of use may be amended or supplemented at any time, so website users are advised to consult them regularly.

    This website is normally accessible to users at all times. However, its availability may be interrupted for technical maintenance purposes by decision of arteck-design.com, which will then endeavour to inform users in advance of the dates and times of the interruption. The website is updated regularly by the person responsible for publication. Similarly, the legal notices may be modified at any time without notice. Nevertheless, they remain binding on all users, who are advised to consult them as often as possible so as to be aware of any change made thereto.

    The purpose of the website is to provide information about all the company’s activities, and it endeavours to provide information that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or failures to update the information, whether caused by itself or by third-party partners supplying the information.

    All information on the website is given for information only and is subject to change. Furthermore, the information on the arteck-design.com website is not exhaustive. Information is provided subject to modifications being made following publication online.

    Contractual limitations concerning technical data

    The website uses JavaScript technology. The website cannot be held responsible for any equipment damage linked to the use of the website. In addition, users of the website undertake to access the website using recent, virus-free equipment and with an up-to-date, latest-generation browser. The website is hosted by a service provider in the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: no. 2016-679).

    The aim is to provide a service which provides the highest level of accessibility. The host ensures continuity of service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting services for periods kept as short as possible for the purposes in particular of maintenance, improvement of its infrastructures, the malfunctioning of its infrastructures or if the Services are generating traffic deemed to be abnormal.

    The arteck-design.com website and the host cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephony equipment linked in particular to network congestion preventing access to the server.

    arteck-design.com is represented by Daniel COURBIS, its legal representative.

    As the party responsible for processing the data it collects, arteck-design.com undertakes to comply with the legal provisions in force. In particular, it is the responsibility of the company to establish the purposes for which its data is processed, to provide its prospects and customers with full information on the processing of their personal data, once their consent has been obtained, and to maintain an accurate register of such processing. Whenever the website processes personal data, arteck-design.com takes all reasonable steps to ensure that the personal data is accurate and relevant to the purposes for which it is processed.

    Purpose of the data collected

    The arteck-design.com website is likely to process all or part of the data:

    Non-disclosure of personal data

    The arteck-design.com website will not process, host or transfer Information collected about its customers to a country outside the European Union or recognised as “non-adequate” by the European Commission without first informing the customer. However, Arteck remains free to choose its technical and commercial subcontractors provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

    Arteck undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the customer’s information is brought to Arteck’s attention, Arteck must inform the customer as soon as possible and inform them of the corrective measures taken. Furthermore arteck-design.com does not collect any “sensitive data”.

    Notification of incidents

    Despite our best efforts, no method of transmission over the Internet and no method of electronic storage is completely secure. As a result, we cannot guarantee absolute security. If we become aware of a security breach, we will notify the users concerned so that they can take appropriate action. Our incident notification procedures take account of our legal obligations, whether at national or European level. We are committed to keeping our customers fully informed of all matters relating to the security of their account and to providing them with all the information they need to help them meet their own regulatory reporting obligations.

    Applicable law and jurisdiction

    Any dispute in connection with the use of the arteck-design.com website is subject to French law.
